Why do you give free case evaluations?

The reason I give free case evaluations is to give everyday people access to the legal system.  The law is complex and the courts and legal system can be intimidating.  Consumers often don’t stand up for their rights because of this and that just isn’t right.  Unfortunately, employers know this and some will take advantage of their employees by not paying overtime, not allowing breaks or lunch, not paying on time, bouncing checks, or harassing and discriminating against their employees.  It disturbs me when I hear about employers breaking the law and getting away with it because employees did not know their rights and didn’t know where to turn for help.

I always encourage people to contact an attorney to discuss their situation even if it is with another attorney.  In fact, many attorneys will do free consultations and you should definitely take advantage.  People have many reasons for not contacting an attorney.  Maybe the legal system is intimidating.  Maybe English is a second language.  Maybe you don’t consider yourself litigious or you just don’t want to rock the boat.  I have seen many people wait until things get really bad or let time limits expire and wish they had done something sooner.  I have seen many people regret not talking to an attorney, but I have never heard of anyone regretting getting a free consultation.

Remember, just because you talk to a lawyer doesn’t mean you’re committing to take action.  It’s about educating yourself about your rights and options.  I believe in equal access to the legal system.  That’s why I emphasize “no obligation” consultations.  Knowledge is power.  I want people to have equal access to the law and equal footing with their employer.

A free case evaluation allows me to speak to a potential client, evaluate their case, and determine if I can help them in any way.  Sometimes a free consultation is all you need.  In fact, I have been able to help people just by doing a free case evaluation.  Sometimes a letter from my office to the employer is enough.  Other times it may be necessary to pursue your claim with the California Labor Commissioner or bring a lawsuit in Superior Court.

When should I call?

You should call immediately.  You only have a limited amount of time to pursue a claim.  The law and time limits can be complicated.  If you wait too long, you may be prohibited from pursuing your claim.

Even if you are not ready to pursue a claim, it can be helpful to speak to a qualified attorney so you know what your rights are should you choose to file a claim or sue your employer in the future.
